SPECTRUM NATIONAL PARTY (SNP) CONSTITUTION


Clause 1. Name:

1.1 The name of the political party constituted through this constitution will be known as Spectrum National Party and shall be commonly referred to as ‘SNP’.


Clause 2. Founding Statement:

2.1 The Founding Members of SNP met, discussed, exchanged views and thinking, and deliberated on the formation of the SNP. Further, extensive consultations occurred with many interested persons across the country.

2.2 It was agreed and supported by all consulted that the SNP must be established and registered as a Political Party;

2.3 SNP is a multi-racial Party led by a dynamic, energised and multi-racial component of respectable leaders;

2.4 The Founding Members agreed on the following:

2.4.1 That South Africa is a nation under the Almighty God;

2.4.2 SNP represents a new beginning for South Africa, the political landscape and its citizens;

2.4.3 Citizens have the right to be represented by a political party of their choice;

2.4.4 SNP must play a leading role to ensure the representation of all people in decision-making in all levels of government across the country;

2.4.5 SNP believes in a “South Africans First” approach in an economically strong, safe and prosperous South Africa;

2.4.6 That an accelerated “free of charge” programme of quality education and training must be embarked upon for all to maximise the economic independence of all South Africans;

2.4.7 There must be a concerted real effort to address, improve and rectify issues that inhibit real progress in socio-economic development;

2.4.8 SNP shall address issues such as the unacceptably high cost of living, the education system, high crime rate, unemployment, landlessness, health, poverty, housing, food security, environmental issues, justice, housing, infrastructure and all other areas and issues that negatively affect South Africans;

2.4.9 SNP shall develop stringent checks and balances, improve systems and processes for the prevention of corruption at all levels in the government and private sectors;

2.4.10 Restrictive factors such as mediocracy, favouritism, biasness, nepotism, ineptitude, corruption, fraud and other social ills that severely hamper and undermine the ability of the State to execute its functions shall be eradicated;

2.4.11 SNP shall recognise and work at developing systems and processes to retain the skills of health-care workers, doctors and nurses, educators, engineers and other scarce skills;

2.4.12 SNP shall ensure a strong, well-resourced, well-trained and competent public sector that is responsive to the needs of all communities;

2.4.13 SNP shall work tirelessly to ensure decent allowances of state financial benefits for the aged, pensioners, all physically and mentally challenged citizens and children;

2.4.14 SNP shall work tirelessly to ensure a safe environment for all the people of South Africa;

2.4.15 SNP shall be actively involved in peace and stability efforts within and outside the country and will establish good and meaningful relations with other nations;

2.4.16 SNP shall vigorously work for the common good of all South Africans.


Clause 3. Vision of SNP

3.1 SNP envisions an economically prosperous, safe and progressive South Africa, where all people live peacefully, side by side, whilst enjoying the fruits of their labour in a developed and thriving economy;

3.2 Where the weak, poor and marginalized are empowered to take their rightful place and meaningfully contribute to the development of our country;

3.3 Where all South Africans are proud of their heritage, culture, language and citizenship in an equal opportunity society under a democratically elected and responsive government;


Clause 4. Mission of SNP

4.1 Eradicate poverty by facilitating and enabling our disparate range of industries and economic activities to create genuine and sustainable work opportunities;

4.2 Adequately fund and roll-out free quality educational programmes specifically aimed at the upskilling of workers and the training of the youth and new entrants into the labour market in preparation for the current challenges in industry and that of the fourth industrial revolution;

4.3 Engage local and international job creation experts of leading world economies for assistance with the implementation of successful turn-around national economic strategies;

4.4 Kick-start the economy by injecting funds into economic initiatives by large labour absorbing industries such as mining, food processing and agriculture and initiate large scale public-private developments and partnerships;

4.5 Drastically improve standards of all public facilities and public service providers including health, education, policing, revenue collection, justice and others through effective and accountable management practices and processes; 

4.6 Fund and roll-out reliable and affordable state of the art infrastructure programmes managed by qualified, experienced Management Boards with integrity to support and increase the possibilities for opportunities of a rapidly increasing population and that of a world-class economy;

4.7 Engage in a comprehensive evaluation exercise and analysis of state subsidized and funded economic activities, State Owned Enterprises and other critical state institutions;

4.8 Market South Africa as an investment destination through the granting of special taxation benefits and other associated economic stimulants applicable to free economic zones in order to attract local and other investors to these and other areas in South Africa that experience high levels of unemployment;

4.9 Encourage and support the farming economy and address the issue of landlessness whilst avoiding a negative impact on food security, on the economy and the displacement of people;


Clause 5: Aims and Objectives of SNP

5.1 SNP aims to:

5.1.1 Harmoniously unite all the people of South Africa irrespective of race, colour, religion, or creed;

5.1.2 Foster and promote race relations and democracy by strengthening Chapter Nine institutions;

5.1.3 Work for social justice, narrow the huge gap in inequalities and create equal opportunities for all;

5.1.4 Build a strong, sophisticated and mixed economy in an attractive and conducive environment for local and foreign investment;

5.1.5 Promote, respect and abide by the constitution of South Africa;

5.1.6 Fast track the improvement of the State Security Apparatus by providing effective world class training and standards in the quest to create a safer South Africa, and to deal decisively with criminality through an improved and efficient criminal justice system;

5.1.7 Support, strengthen and encourage the lawful struggle of all citizens in the attainment of a responsive government that cares for its citizens;

5.1.8 Establish good relations with other nations and international bodies such as the African Union, United Nations and others;

5.1.9 Strongly support and promote peace and stability within the country and beyond;

5.1.10 Build strong, competent and well-resourced public institutions that are responsive to the needs of all people;

5.1.11 Re-engineer, fund and greatly improve efficiency, operational methods and standards of all government institutions and services;

5.1.12 In addition to current laws, put in place foul-proof checks and balances to ensure that state resources are expended lawfully, ethically and in terms of priorities and, where deviation from guidelines and rules in the form of unlawfulness, inaction and disregard occurs, decisive punitive action must be taken against officials and office bearers;

5.1.13 Promote, protect and guarantee the free movement of all people and goods within our borders and effectively market South Africa as a tourist destination both locally and internationally;

5.1.14 Develop and support training initiatives for potential entrepreneurs and find solutions that create sustainable opportunities for new participants in the economy;

5.1.15 Promote South Africa as the gate-way and best investment destination in Africa;

5.1.16 Strongly encourage farming and seek ways of assisting all farmers in times of drought and other disastrous occurrences and provide expert support to new entrants to the farming sector;

5.1.17 Embark on a carefully worked out and affordable national infrastructure development programme across South Africa that should include roads, rail, water facilities, sewerage, electrification, housing, transport and the like;

5.1.18 Ensure adequate protection of the environment, its eco-systems and natural resources through effective legislation and law enforcement;

5.1.19 Introduce qualified credible personnel at all levels of government and implement effective management systems and practices, and engrain a new public service ethos;

5.1.20 Ensure access and ownership of land by the landless through a careful process of land allocation and redistribution without disrupting and paralysing food security.

5.1.21 Establish good relations with rural communities and rural leaders, strongly promote township and rural development initiatives and small business;

5.1.22 Carefully and expertly examine the prospects, challenges, advantages and disadvantages for the establishment or the expansion of properly planned and appropriately zoned economic growth-points throughout South Africa to lessen the high impact of current urbanisation patterns on the major cities around the country.


Clause 6: Character of SNP

6.1 Is a democratic, non-sexist and non-racial organisation;

6.2 Is a peaceful, organized, focussed and an objective collective of South Africans with strong views and opinions on issues that affect our people;

6.3 SNP believes that all policies and programmes of government must be for the benefit of all South Africans;

6.4 Supports and encourages the attainment of political power through the democratic processes;

6.5 Believes in multi-party democracy and peaceful dialogue;

6.6 Encourages and practices freedom of speech;

6.7 Party Leadership is accountable to its membership;

6.8 Strongly supports and promotes transparency and accountability;

6.9 It is responsive to the needs of all citizens;

6.10 Believes that a well-trained, well-resourced and well managed and effective public service is central for the achievement of government objectives and ensuring a satisfied citizenry;

6.11 Protects and promotes the integrity of South Africa and all its people;

6.12 Strongly believes that people of all races and groups must be treated fairly and must have an equal chance in accessing opportunities;

6.13 Criminal activity of any sort disrupts the aspirations and development of communities and accordingly must be dealt with decisively in terms of laws of the Republic and where necessary laws must be improved and amended to meet this challenge.


Clause 7: Legal Nature and Powers

7.1 SNP shall have the right to:

7.1.1 Exist, separately from its members;

7.1.2 It shall continue to exist when there is a change of office bearers or its membership;

7.1.3 Purchase or lease moveable and immoveable property;

7.1.4 Manage or dispose of its assets as it deems fit;

7.1.5 Sue and be sued in its own name;

7.1.6 Enter into any contractual agreement in or outside the Republic;

7.1.7 Open and operate a bank account or bank accounts and be able to transact;

7.1.8 Manage and oversee all monies received and raised including its assets;

7.1.9 Recruit and engage the services of employees.

7.1.10 Manage and oversee all its internal processes;


Clause 8: Membership of SNP

8.1 Is open to all South Africans, male and female from the age of eighteen years and above;

8.2 Members are required to sign a membership form;

8.3 Members must pay an annual membership fee;

8.4 Members will be issued with a form of identification;

8.5 Membership is voluntary, and members are free to resign at any time;

8.6 A member who resigns must submit a written letter of resignation to the office of the Provincial Secretary;

8.7 Dual party membership is not permitted;

8.8 Members who opt to pay their membership fees annually must ensure that such fees are kept up to date;

8.9 Membership fees may change from time to time;

8.10 Joining fees must be paid within three months upon signing up as a new member; and thereafter a monthly compulsory membership fee becomes payable;

8.11 The compulsory membership fees must be paid by all members of SNP structures and shall be paid into the National Bank Account of the SNP;

8.12 All members are bound by SNP policies, processes, and procedures;

8.13 If and when Provincial fees have not been paid, follow-up shall be done by the Office of the Secretary General and or Treasurer General;

8.14 Accurate records shall be kept of all members, income/ expenses, of all transactions including an accurate asset register at the Provincial Office.

8.15 SNP National Office will be copied in all operational and administrative activities of branches, regions and provinces;


Clause 9: Rights of SNP Members

9.1 Members shall have the right to:

9.1.1 Participate in discussions at the appropriate level;

9.1.2 Participate in promoting the ideals and vision of SNP;

9.1.3 Contribute ideas and impart constructive critism;

9.1.4 Objectively question ideas, proposals and decisions of SNP;

9.1.5 Seek clarification of policies, proposals, programmes or advice from within Party structures;

9.1.6 Participate in and contribute positively to organisational matters;

9.1.7 Be elected, nominated or appointed to any structure, committee or delegation;

9.1.8 Submit written proposals to any SNP structure on any matter;

9.1.9 Voice unhappiness and dissatisfaction on any matter, in writing to the Provincial Secretary in a professional and respectable manner.

9.1.10 Should a matter referred to in 9.1.9 above be not resolved, the matter may be escalated to the Office of the Secretary General.


Clause 10. Responsibilities of SNP Members

10.1 Members of SNP shall:

10.1.1 Ensure that they are registered as voters;

10.1.2 Ensure that their SNP membership is paid up;

10.1.3 Participate in and contribute positively to all activities of SNP;

10.1.4 Play a constructive and active part in the execution of any duty, role or position to which a member is appointed, nominated or elected;

10.1.5 Be on the alert for the unauthorised use of SNP regalia, stationery and any other SNP property and to report such unauthorised use or abuse;

10.1.6 Always project SNP in a positive light;

10.1.7 Be familiar with and correctly articulate SNP policies;

10.1.8 Take his or her rightful place as a good citizen;

10.1.9 Not to embarrass or bring the good name of SNP into disrepute;

10.1.10 Utilize all resources for SNP purposes only;

10.1.11 Under no circumstances shall any media statements be made to any media-house, newspaper, news magazine, reporter, journalist, or on any social platform unless expressly authorised in writing, agreed and assigned by the National Executive Council;

10.1.12 Under no circumstances shall members participate in any unlawful or violent strikes and activities.


Clause 11. SNP Women’s League and SNP Youth League

11.1 Women and Youth shall have the right to:

11.1.1 Establish a Women’s League and Youth League respectively;

11.1.2 Membership in Women’s League shall be open to all female members;

11.1.3 Membership of the Youth League is open to all members between the ages of 18 and 35 years;

11.1.4 Women and Youth who opt to join the Women and the Youth Leagues, shall remain members of SNP;

11.1.5 This constitution is applicable to all members of the Women’s League and the Youth League.


Clause 12. Administrative Offices of SNP

12.1 The offices of SNP are the places where Party administration occurs;

12.2 The location of administrative offices shall be determined as follows:

12.2.1 National Head Office by the National Executive Council;

12.2.2 Provincial Offices by the Provincial Executive Councils;

12.2.3 Regional Offices by the Regional Executive Councils;

12.2.4 Branch Offices by the Branch Executive Councils;

12.3 The location of any SNP offices shall be in a locality that facilitates easy access for members and the public;

12.4 Offices shall be kept neat and tidy.


Clause 13. Discipline, Appeal and Arbitration (Misconduct, Panels & Process)

13.1 Misconduct shall constitute:

13.1.1 Failure to conform to SNP policy;

13.1.2 Contravention of any provision of this constitution and or rules made under it;

13.1.3 Failure to abide by, conform to or execute any decision or instruction taken or given by an Office Bearer or given at and by any properly constituted APA meeting;

13.1.4 Any conduct which brings SNP into disrepute;

13.1.5 Any conduct or act aimed at discrediting and embarrassing SNP, its Office Bearers, Employees and its policies and processes;

13.1.6 Directly or indirectly causing discontent, or disunity within SNP structures;

13.1.7 Gross insubordination, corruption, fraud, theft and abuse of assets;

13.1.8 Holding any unauthorised press conference, meeting or briefing without the express authority, in writing, of the National Executive Council;

13.1.9 Making unauthorised public statements or leaking of any information on any matter of SNP to any person, organisation or media;

13.1.10 Committing any act that may cause or have the potential to cause a rift or split in SNP structures;

13.1.11 Create or influence members or participate in the establishment of any unlawful parallel political structure to SNP other than those contained in this constitution;

13.1.12 Express to any member or other person or the media or on any social platform an intention to resign from SNP, or express an interest in joining another Party whilst still a member of SNP;

13.1.13 Disrupting any SNP meeting whether alone or in concert with others or the instigation of and or the participation in a disruption;

13.2 Disciplinary, Appeal and Arbitration Panels

13.2.1 Provincial, Regional and Branch Executive Councils shall have the right to appoint Disciplinary, Appeal and Arbitration Panels consisting of a minimum of six members provided:

13.2.1.1 At least one but not more than three members of the National Executive Council must serve on any such panel;

13.2.1.2 The Chairperson of a panel constituted in terms of clause 13.2.1 must be a member of a Provincial, a Regional or a Branch Executive Council who has sufficient experience and knowledge of the SNP organisational workings, vision, rules and procedures;

13.2.1.3 In cases where a member of the National Executive Council is accused of or has committed an act in violation of this constitution, the National Executive Council reserves the right to deliberate on the matter, appoint or nominate from amongst the other members of the National Executive Council to constitute a Disciplinary Panel consisting of any number of members to investigate, enquire and adjudicate on the matter and, such panel shall be chaired by a member appointed by the National Executive Council;

13.2.1.4 A Disciplinary Panel or an Arbitrator or an Appeal Panel may impose any sanction providing such sanction is commensurate with the offence committed;

13.2.1.5 A sanction imposed by a Disciplinary, Appeal or an Arbitration Panel may be suspended wholly or in part upon such conditions as the panel may deem fit;

13.2.1.6 A sanction imposed by any panel in terms of this constitution shall remain in force and effect notwithstanding any pending appeal;

13.2.1.7 Members appointed to serve on a panel must have no interest in the matter;

13.2.1.8 Where possible, panels must be representative of the race groups and gender in SNP;

13.2.1.9 An thorough investigation into the matter must be conducted;

13.2.1.10 After hearing all the evidence of the accused and witnesses, if any, Chairpersons must adjudicate on the matter after consultation with all members of the panel;

13.2.1.11 An accused or co-accused must be given at least seven days prior notice, in writing, of the intention to proceed with a hearing and such written notification must contain:

13.2.1.11.1 the number and nature of the charge(s);

13.2.1.11.2 the date on which the misconduct is alleged to have occurred;

13.2.1.11.3 the date on which the hearing is to be held,

13.2.1.11.4 the time of the hearing;

13.2.1.11.5 the place where the hearing is to be held;

13.2.1.11.6 Any other relevant information pertaining to the hearing;

13.2.1.12 An accused has the right to be represented and assisted by another member of SNP and may call witnesses;

13.2.1.13 Panels must ensure consistency in application of all processes by giving the accused a fair hearing and an opportunity to raise and articulate his or her defence;

13.2.1.14 A panel constituted in terms of clause 13.2.1 and clause 13.2.1.3 has the right to put questions to the accused;

13.2.1.15 Hearings must be held at the nearest Branch Office;

13.2.1.16 All evidence must be considered and weighed up before any sanction is imposed, reduced or suspended;

13.2.1.17 An accused has the right to appeal in writing to a higher Party structure should he or she be of the strong view that a fair hearing would not be granted by a panel;

13.2.1.18 An accused member that lodges an appeal to a higher authority in Party structures in terms of clause 13.2.1.17, shall in writing, at least seven days prior to the commencement of such hearing, articulate clearly, all reasons for lodging the appeal;

13.2.1.19 An Appeal Panel shall be established by the Office of the Secretary General after consultation with relevant SNP structures at the different levels;

13.2.1.20 The Chairpersons of Panels must act independently of any influence, be fair, act without prejudice or bias, and must always aim to unify SNP;

13.2.1.21 The accused has the right to request an interpreter of the language of his choice at least three days prior to the hearing date.


Clause 14 National Convention

14.1 Frequency:

14.1.1 A National Convention shall be held once every year or as soon as it is reasonably possible after the expiry of one year;

14.1.2 Provincial, Regional and Branch Conventions must be held in the same year that the National Convention is to be held but prior to the commencement of the National Convention;

14.1.3 If for any reason, National Convention cannot be held, the National Executive Council, through the Secretary General, will pronounce on the matter;

14.1.4 The Secretary General will be responsible for all liaison between the National Executive Council and structures of SNP;


Clause 15 Powers of the National Convention

15.1 National Convention shall be the supreme policy-making body of the African Peoples Alliance;

15.1.1 During the Founding and Interim Phase, the Founding President of SNP shall have the right to appoint:

15.1.1.1 The Deputy President;

15.1.1.2 The National Chairperson

15.1.1.3 The Deputy National Chairperson;

15.1.1.4 The Secretary General;

15.1.1.5 The Deputy Secretary General;

15.1.1.6 The Treasurer General;

15.1.1.7 The Deputy Treasurer General;

15.1.1.8 The Provincial Leader(s) of each Province. 


Clause 16 The Rights of National Convention

16.1 National Convention has the right to:

16.1.1 Ratify or amend Party policy;

16.1.2 Determine annual membership fees;

16.1.3 Amend the Party constitution;

16.1.4 Vote on resolutions presented by Branches;

16.1.5 Receive and discuss reports from SNP structures;

16.1.6 Appoint committees to undertake various projects or assignments;

16.1.7 Appoint legal advisors, auditors and other experts in any field as it may be deemed necessary to fulfil the objectives of SNP.


Clause 17 Calling of a National Convention

17.1 The calling of a National Convention shall be executed by the Office of the Secretary General as follows:

17.1.1 By letter or email to Provincial Leaders;

17.1.2 Not later than ninety (90) days before its commencement;

17.1.3 Additional members to the National Convention members shall under no circumstances be permitted to participate in proceedings and shall have observer status;

17.1.4 A Special National Convention may be called at the discretion of the National Executive Council within a period of seven days, by giving written notice to:

17.1.4.1 The Provincial Chairpersons;

17.1.4.2 The Provincial Secretaries;

17.1.4.3 The Provincial Deputy Secretaries;

17.1.5 The notice from the Office of the Secretary General calling for a Regular Convention or Special National Convention to amend this constitution, shall expressly stipulate the proposed amendments;

17.1.6 The National Executive Council reserves the right to decide where the National Convention shall be held.


Clause 18 Delegates to the National Convention

18.1 Eligible members:

18.1.1 National Executive Council members shall attend as full participants in and as delegates to the Convention;

18.1.2 The number of additional voting delegates shall be allocated by the National Executive Council from amongst members of:

18.1.2.1 Provincial Executive Councils;

18.1.2.2 Women’s League and Youth League;

18.1.3 The Office of the Secretary General shall be responsible for making all the necessary arrangements for the National Convention;

18.1.4 The National Executive Council shall determine the date, time, and the place on which and where the National Convention takes place;


Clause 19. Structure of SNP

19.1 The structure of SNP is:

19.1.1 The National Executive Council (NEC);

19.1.2 The Provincial Executive Councils (PECs);

19.1.3 The Regional Executive Councils (RECs);

19.1.4 The Branch Executive Councils (BECs);

19.1.5 Ward Organising Committees (WOCs);


Clause 20 The Status of the National Executive Council

20.1. The National Executive Council is the highest decision-making body of Spectrum National Party;

20.2 It is elected by accredited delegates with voting rights in attendance at National Convention.


Clause 21 Composition of SNP Structures

21.1 National Executive Council:

21.1.1 The President;

21.1.2 The Deputy President;

21.1.3 The National Chairperson;

21.1.4 The Deputy National Chairperson;

21.1.5 The Secretary General

21.1.6 The Deputy Secretary General;

21.1.7 The Treasurer General;

21.1.8 The Deputy Treasurer General;

21.1.9 The Chief Whip

21.1.10 The Provincial Chairpersons who serve as ex-officio members;

21.1.11 As a start-up Party, the Founding President reserves the right to appoint or nominate any number of additional members to serve as full members or as temporary members of the National Executive Council as the case maybe;


Clause 22 Provincial Executive Councils

22.1 Composition

22.1.1 The Provincial Chairperson;

22.1.2 Three Deputy Provincial Chairpersons of different race-groups;

22.1.3 The Provincial Secretary;

22.1.4 The Deputy Provincial Secretary;

22.1.5 Provincial Treasurer;

22.1.6 Deputy Provincial Treasurer;

22.1.7 Provincial Organiser (Working Groups);

22.1.8 Thirty (30) additional members elected by delegates in attendance at the Provincial Convention;

22.1.9 As a new start-up Party, the Provincial Chairperson shall, in addition to Clause 26, be responsible for the following:

22.1.9.1 For the appointment of members in good standing to the Provincial Executive Council in conjunction with the Founding President;

22.1.9.2 As far as possible, ensure that the racial composition of the Provincial Executive Council is representative of the four South African races;

22.1.9.3 Co-ordinating the establishment of the Provincial Executive Council, Regional Executive Councils and Branch Executive Councils;

22.1.9.4 Liaise with the Founding President on all the above matters.


Clause 23 Regional Executive Councils

23.1 Composition:

23.1.1 The Regional Chairperson;

23.1.2 The Deputy Regional Chairperson;

23.1.3 The Regional Secretary;

23.1.4 The Regional Deputy Secretary;

23.1.5 The Regional Treasurer

23.1.6 The Regional Deputy Treasurer;

23.1.7 The Regional Organiser;

23.1.8 Branch Chairpersons who serve as ex-officio members;

23.1.9 Thirty (30) additional members elected by delegates in attendance at the Regional Convention;

23.1.10 As far as it is reasonably possible, the racial composition of the Regional Executive Council shall be representative of the various race groups of South Africa.


Clause 24 Branch Executive Councils

24.1 Composition:

24.1.1 The Branch Chairperson;

24.1.2 The Deputy Branch Chairperson;

24.1.3 The Branch Secretary;

24.1.4 The Deputy Branch Secretary;

24.1.5 The Branch Treasurer;

24.1.6 The Ward Organiser

24.1.7 The Ward Chairpersons who serve as ex-officio members;

24.1.8 Thirty (30) additional members elected by delegates in attendance at the Branch Convention;

24.1.9 As far as it is reasonably possible, the Branch Executive Council shall be representative of the various race groups in South Africa.


Clause 25 Powers and Duties of the National Executive Council

25.1 Powers and Duties are:

25.1.1 The National Executive Council is the highest decision-making body of the SNP;

25.1.2 It implements the decisions of National Convention;

25.1.3 Supervises the implementation of National Convention decisions;

25.1.4 Has the power to recall non-performing members and appointees;

25.1.5 Engage or dismiss employees of the Party;

25.1.6 Determine remuneration of employees;

25.1.7 Opens and oversees a Party bank account or bank accounts;

25.1.8 Members must attend all meetings of National Convention;

25.1.9 It must prepare and present various reports on administration, financial successes, challenges, national membership statistics and other reports that may be necessary;

25.1.10 Arrange or cause to be arranged all services including logistical and administrative support, legal, audit and all other requirements for the holding of the National Convention;

25.1.11 Must verify all documentation, quotations, proposals received for the holding of the National Convention;

25.1.12 Calls for and issues notice to the Provincial Executive Councils on the sitting of the National Convention or a Special National Convention;

25.1.13 Determines the number of voting delegates to the National Convention from Provincial, Regional and Branch structures;

25.1.14 Determines the rules, policies and guidelines to be adhered to for the achievement of a successful National Convention;

25.1.15 Appoints a National Convention Spokesperson to articulate National Convention issues, statements and positions;

25.1.16 Pay service providers for services provided to the National Convention;

25.1.17 Appoint commission(s) of enquiry to investigate any matter;

25.1.18 A Commission of Enquiry as envisaged in 25.1.17 shall comprise of not more than three members of the National Executive Council;

25.1.19 Ensure the accurate articulation of policies, rules and procedures of SNP at all levels;

25.1.20 Determine the extent and physical boundaries of structures;

25.1.21 Secretary General will chair meetings of the National Executive Council;

25.1.22 Members may resign at any time;

25.1.23 It develops rules, policies and guidelines for selection to the National Assembly, Provincial Legislatures and Municipal councils and any other government structure;

25.1.24 It accepts or declines any application for membership of the SNP;

25.1.25 It accepts or rejects proposals, requests or invitations to form an alliance with any other organisation(s);

25.1.26 A member of the National Executive Council, may submit motivated proposals on any matter for consideration by the Secretary General.

25.1.27 It must supervise, direct and oversee the work of all SNP structures in Provinces, Regions, Branches as well as all SNP caucuses in National, Provincial and Local Government levels;

25.1.28 It must supervise the work of the Youth League and Women’s League;

25.1.29 It must ensure that Provincial, Regional and Branch structures operate fairly and democratically.


Clause 26 Powers and Duties of Provincial Executive Council

26.1 Powers and Duties are:

26.1.1 Oversee all campaigns and programmes in the Province;

26.1.2 Recruitment of members;

26.1.3 Oversee administration, fundraising and membership drives;

26.1.4 Support efforts of other Party structures;

26.1.5 Open, operate and oversee a Provincial Bank Account;

26.1.6 Assist the Regional and Branch Executive Councils;

26.1.7 Consult and seek guidance and advise from the National Executive Council;

26.1.8 Educate the public and members on policies and processes of the SNP;

26.1.9 Must meet once a month on an agreed date with at least one National Executive Council member present;

26.1.10 Provincial Executive Council shall be elected by secret ballot at the Provincial Convention;

26.1.11 Elected members shall be eligible for re-election;

26.1.12 Nominations must be in writing and must be submitted to the Provincial Executive Council at least ninety days before the commencement of the Provincial Convention;

26.1.13 Members are not permitted to nominate themselves.

26.1.14 Nominees must be approached in advance to confirm their willingness for nomination before any submission of names is made to the Provincial Executive Council;

26.1.15 Nominees must sign nominations forms and nomination forms which must be seconded;

26.1.16 Shall convene a Provincial Convention once a year before the National Convention commences;

26.1.17 Provincial Executive Council must meet once every month with at least one member of the National Executive Council present;

26.1.18 Submit monthly written reports to the National Executive Council;

26.1.19 Provincial meetings will be chaired by the Provincial Chairperson.

26.1.20 May appoint an ad-hoc committee as may be deemed necessary to investigate and establish facts on any Party matter serious enough to necessitate an investigation;

26.1.21 An ad-hoc committee established in terms of subclause 26.1.20 above shall consist of no more than ten members and be chaired by a member of the Provincial Executive Council.

26.1.22 Must actively mobilise support for the Party within the Province.

26.1.23 Must establish and actively support Organising Committees.

26.1.24 Must appoint a disciplinary committee to deal with disciplinary matters in the Province in consultation with the Secretary General;

26.1.25 A disciplinary committee envisaged in 26.1.24 above shall be chaired by the Provincial Chairperson and assisted by not less than two members of the National Executive Council;

26.1.26 A Provincial Executive Council must be beyond reproach and exercise a high degree of professionalism and accountability;

26.1.27 The Provincial Executive Council must regularly interact with the National Executive Council concerning Provincial matters.

26.1.28 Provincial Executive Committees may submit motivated proposals on any matter for consideration by the Secretary General;


Clause 27 Powers and Duties of Regional Executive Councils

27.1 Powers and Duties are:

27.1.1 Oversee all programmes and campaigns in the region;

27.1.2 Recruitment of members;

27.1.3 Oversee administration, fundraising and membership drives;

27.1.4 Render assistance to other structures on an ongoing basis all matters and provide any other assistance as and when directed to do so;

27.1.5 Seek guidance and advice from the Provincial Executive Council;

27.1.6 Educate the public and membership on Party policies;

27.1.7 Must meet once a month on an agreed date;

27.1.8 All elections must be by way of secret ballot;

27.1.9 Elected members are eligible for re-election;

27.1.10 All nominations must be in writing, be seconded and signed before submission to the Regional Executive Council within ninety days before the commencement of the Regional Executive Council meeting;

27.1.11 Members are not permitted to nominate themselves;

27.1.12 Nominees must be approached in advance to confirm their willingness to be nominated before the submission of their names to the Regional Executive Council;

27.1.13 Regional Executive Council must convene a Regional Convention once a year before the commencement of the Provincial Convention;

27.1.14 Must submit written monthly reports on all activities, campaigns and programmes to the Provincial Executive Council;

27.1.15 Meetings are chaired by the Regional Chairperson and assisted by at least two members of the Provincial Executive Council and by at least two members of the National Executive Council;

27.1.16 May appoint a committee of no more than six members, chaired by a member of the National Executive Council, to investigate any serious matter in the region;

27.1.17 It must mobilise support for the Party in the Region.

27.1.18 Must assist Branch Executive Councils in the establishment of Organising Committees;

27.1.19 Appoint a disciplinary committee to deal with disciplinary matters;

27.1.20 A disciplinary committee shall be chaired by the Regional Chairperson and assisted by members of the Provincial Executive Council and no more than two members of the National Executive Council respectively;


Clause 28 Powers and Duties of Branch Executive Committees

28.1 Powers and Duties are:

28.1.1 Implement and oversee programmes, campaigns and membership drives;

28.1.2 Recruitment of members;

28.1.3 Oversee Branch administration, fundraising and the establishment of good relations with members, business and the public;

28.1.4 Assist other Party structures as and when instructed or required;

28.1.5 Consult, seek guidance and advice on any matter from the Regional Executive Council;

28.1.6 Educate the public and members on Party policies and programmes;

28.1.7 Must meet at least once a month;

28.1.8 Elections must be held by secret ballot;

28.1.9 Elected members are eligible for re-election;

28.1.10 Nominees must be approached in advance to confirm their willingness to be nominated prior to their names being submitted to the Branch Executive Committee;

28.1.11 Nominees must sign nomination forms which must be seconded and signed;

28.1.12 Must identify and be familiar with local issues;

28.1.13 Must identify local projects and community-based activities;

28.1.14 Must mobilize public support for Party programmes;

28.1.15 Must organise, oversee and run effective election campaigns;

28.1.16 Establish, nominate or elect a Ward Organising Committee;

28.1.17 The life of a Ward Organising Committee shall be determined by the Branch Executive Council but shall not exceed two years;

28.1.18 May appoint a disciplinary committee to deal with disciplinary matters of both the Branch and Ward Organising Committees and shall be chaired by the Branch Chairperson and assisted by members of the Provincial and National Executive Councils.

28.1.19 Ward Organising Committees must be present at each Independent Electoral Commission voting station and be present during the counting of votes to ensure that the correct number of votes are recorded.


Clause 29 Ward Organising Committees

29.1 Composition:

29.1.1 The Chairperson;

29.1.2 The Deputy Chairperson;

29.1.3 The Secretary;

29.1.4 The Treasurer;

29.1.5 The Organiser

29.1.6 The Co-ordinator

29.1.7 Thirty (30) additional members.


Clause 30 Powers and Duties of Ward Organising Committee

30.1 Powers and Duties are:

30.1.1 Must keep accurate records on campaigns, plans, attendance, political mobilisation activities, funds received, minutes of meetings, volunteer lists, regalia issued, petty cash, transactions, purchases, payments, and any other records for purposes of accountability;

30.1.2 Mobilise and grow SNP support and membership in wards;

30.1.3 Recruitment processes and documentation to be correctly completed, signed and handed over to the Branch Secretary;

30.1.4 Have a good understanding of the vision, objectives, rules, policies, and other issues relating to the functioning of SNP;

30.1.5 Must keep abreast of developments in the political landscape;

30.1.6 Motivate the public to register as voters;

30.1.7 Explain the importance of voting on election days;

30.1.8 Encourage members of the public through peaceful dialogue and

convincing skills to sign up as members but never to force any person to take up membership;

30.1.9 Avoid conflict at all times;

30.1.10 Report violence or threats of violence to the Ward Chairperson or the Deputy Chairperson;

30.1.11 Develop a professional relationship with all members and the public;

30.1.12 Intricate questions from a member of the public should be referred to the Ward Chairperson;

30.1.13 Chairperson must submit reports to the Branch Executive Council on the progress and challenges in ward activities.


Clause 31 Meetings of the SNP

31.1 Meeting protocols, processes and procedures shall be observed at all formal meetings;

31.2 Meetings must be chaired by a competent Chairperson;

31.3 Agendas and previous minutes must be circulated in advance;

31.4 The agenda items must be discussed;

31.5 Minutes must be taken and accurately reflect proceedings;

31.6 Members in attendance must be free to make contributions, challenge and pose questions on any agenda item in a professional manner;

31.7 The Chairperson is authorised to consider the inclusion or exclusion of any matter raised at the meeting;

31.8 Members must come to all meetings prepared;

31.9 The quorum for all Party meetings is fifty plus one (50 +1).

31.10 Attendees at all meetings must ensure that they sign the attendance register and include all their contact details.


Clause 32 Rights of Founding Members

32.1 All Founding Members of the SNP shall have the right:

32.1.1 To permanently serve as Office Bearers in National and Provincial Party structures to ensure consistency and the uninterrupted continuance of the SNP vision subject to the provisions contained in Subclauses 13.1 and 33.8 respectively;

32.1.2 Shall have the right to resign or step-down at any time;

32.1.3 Shall always act professionally, ethically and shall display a high level of accountability;

32.1.4 Shall always render guidance to members;

32.1.5 Shall consult on Party issues;

32.1.6 Shall project the image of SNP in a positive light;

32.1.7 Shall consult and take decisions in the best interest of SNP;


Clause 33. Powers of the President of SNP

33.1 The President shall periodically present an overall national report on the activities, challenges and progress of the SNP to the National Executive Council;

33.2 Will make pronouncements for and on behalf of the National Executive council;

33.3 Will present a national statement on issues and challenges facing the country;

33.4 Will steer and direct all activities of the SNP;

33.5 In consultation with National Executive Council, appoint or nominate any member to serve on any structure of SNP;

33.6 Shall have final decision-making powers on candidate lists for National, Provincial and Municipal legislatures and councils;

33.7 Shall have final decision-making powers on any other matter at any level within SNP structures;

33.8 The President may relieve any member for:

33.8.1 Non-performance;

33.8.2 Bringing the Party into disrepute;

33.8.3 Any attempt or actual criminal conduct, misappropriation of funds or involvement in any other unlawful activities;

33.8.4 Loss of confidence and trust in that member or members;

33.8.5 Any unlawful action or misconduct that is designed or calculated for personal financial benefit or for the benefit of family, friends, and or  associates, and or the facilitation of any unlawful activity or making a promise of benefit to any other person or organisation;

33.8.6 Making any public statements that promote or encourage racial or violent conflict between race groups;

33.8.7 Leaking any sensitive information, in any way, pertaining to the personal lives of any member of SNP;

33.8.8 Leaking any information concerning SNP political strategies, finances, or any other confidential information to any person or organisation;

33.8.9 Abuse of SNP resources, its trademark, ideas or protected rights.

33.8.10 The National Executive Council and Provincial Executive Councils shall first consult the President on and before any decisions are taken on all major National and Provincial matters.


Clause 34 Elections and Voting in SNP

34.1 All decisions shall be taken by a simple majority;

34.2 Voting will continue until a decision by a simple majority is reached.

34.3 Voting shall be by secret ballot;

34.4 No member shall be permitted to vote by proxy;

34.5 All accredited members shall have one vote.

34.6 An Executive Council shall appoint a Supervisory Panel consisting of a minimum of eight (8) members but not more than twelve (12) who are of good standing to supervise voting processes.

34.7 Voting processes shall always be held in a professional manner and in terms of SNP policies and procedures;

34.8 The Office of the Secretary General shall always be kept up to date on all issues pertaining to elections and voting in structures;

34.9 A delegation of not more than six members of the National Executive Council shall have the right to attend and remain in attendance during any voting process in the structures of SNP.


35. Succession Planning in SNP

35.1 Every member starts his or her career at the junior level of the SNP with the exclusion of the Founding Members;

35.2 Members must gain maximum experience in all aspects and processes by voluntarily demonstrating their availability, willingness, integrity and eagerness to learn, apply, abide by and respect SNP processes, rules, procedures including the ability to correctly articulate SNP policies;

35.3 Members start their careers as foot-soldiers in SNP and progress through the ranks as follows:

35.3.1 Ordinary card-carrying members and supporters;

35.3.2 Members of Ward Organising Committees;

35.3.3 Branch Executive Council members;

35.3.4 Regional Executive Council members;

35.3.5 Provincial Executive Council members;

35.3.6 National Executive Council members.

35.4 In addition to the requirements stated in sub clause 35.2, the National Executive Council s hall develop, revise, amend and apply stringent guidelines, requirements and competencies for the appointment of members to any office of SNP structures, National, Provincial and to municipal governments.

35.5 As in any organisation, there are a limited number of vacancies and in order to ensure sound growth and development, the SNP, through its management structures will constantly monitor work performance of all its members;

35.6 The President may source, recommend, appoint, engage or contract any person or member who possesses a set of special skills or professional training and experience to carry out duties and functions of a special nature.
